These General Terms and Conditions are governed by Act No. 89/2012 Coll., the Civil Code (hereinafter the “Civil Code”), and Act No. 634/1992 Coll., on Consumer Protection, as amended (hereinafter the “Consumer Protection Act”).
These General Terms and Conditions (hereinafter “GTC”) are issued by the company Ostrovy s.r.o., ID No. 27232948, registered office Terronská 3, Dejvice, 160 00 Prague 6, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 106391 (hereinafter the “Organizer” or “Seller”), which is the organizer of the event www.unitedklubovna.cz (hereinafter the “Event”), as well as other cultural events organized by the Organizer, to which these GTC apply accordingly.
These GTC form an integral part of the Purchase Agreement for the purchase of tickets to the Event (hereinafter the “Purchase Agreement”).
The purpose of the GTC is to govern the contractual relationship between the person entering into a contractual relationship with the Organizer when purchasing tickets (hereinafter the “Participant” or “Buyer”) and the Organizer.
Submitting an online order for tickets constitutes acceptance of these GTC, which the Participant may review on the Event website www.unitedislands.cz. The version of the GTC effective on the date of the order or ticket purchase applies.
“Online Shop” means the online system operated on the websites www.unitedislands.cz or www.goout.cz, which enables the conclusion of Purchase Agreements between the Organizer and the Participant via remote communication tools. The Participant agrees to the use of remote communication tools for concluding the Purchase Agreement.
In the case of a personal purchase at a physical ticket desk, those provisions of the GTC that cannot apply due to the nature of such purchase shall not be used.
A “Ticket” means an electronic ticket in PDF format sent to the Participant by email after online payment or after payment by bank transfer has been credited to the Organizer’s bank account.
A “Purchase Agreement” means a purchase agreement within the meaning of Sections 2079 et seq. of the Civil Code, concluded between the Organizer as the seller and the Participant as the buyer through the Online Shop.
An “Order” means a binding electronic proposal to conclude a Purchase Agreement, created by filling in the necessary information in the order form (e.g. quantity, delivery email address), and submitting it to the Seller through the Online Shop.
PLG Czech Republic, s.r.o., registered at Churchill I, Italská 2581/67, 120 00 Prague 2, ID No. 01901613, is the provider of ticketing services through which the Organizer sells Tickets via www.unitedislands.cz and www.goout.cz.
The Organizer’s GTC take precedence over the terms of PLG Czech Republic, s.r.o. In the event of a conflict, the rights and obligations of the parties shall be governed by these GTC.
A “Consumer” is a person who, when concluding and fulfilling the contract, does not act within their business or professional activity. Consumers are governed by these GTC to the applicable extent, as well as the Civil Code and the Consumer Protection Act.
Terms not defined herein have their usual meaning unless the context clearly indicates otherwise.
Ticket prices are listed in CZK or EUR including VAT. The Organizer is a VAT payer. Any costs incurred by the Participant when using remote communication tools (such as internet fees) are borne by the Participant.
The purchase price may be paid online by card or by other methods offered in the GoOut payment form.
Procedure for placing an order via the Online Shop:
The Buyer selects the number of Tickets and fills in the requested information (e.g. payment method, identification and contact details).
Before submitting the Order, the Buyer may check and correct errors, remove items from the cart, change details, etc. The Organizer is not responsible for incorrect details entered by the Buyer (ticket category, email, phone number, etc.).
Submitting the Order by clicking “ORDER” (or equivalent) constitutes a proposal to conclude the Purchase Agreement.
After payment, the electronic Ticket will be emailed to the Buyer. The Purchase Agreement is concluded when the Order confirmation is delivered to the email address provided by the Buyer. Incorrect contact details may result in cancellation of the Order.
Managing reservations requires registration on www.goout.cz using the same email address as entered in the purchase form.
The Organizer excludes the possibility of accepting an offer with any amendment or reservation. The Purchase Agreement is concluded only through unconditional acceptance.
The Organizer may request additional confirmation of the Order (especially in case of unusually large orders). If not confirmed, the Organizer may require advance payment or refuse to conclude the Purchase Agreement.
The Organizer is not responsible for the validity of tickets purchased outside the Online Shop.
The Purchase Agreement is governed by Czech law and may be concluded in Czech or English.
The Organizer must deliver the ordered Tickets, and the Buyer must pay for them.
The Buyer may choose any available payment method listed in the Online Shop.
The Organizer offers only dated leisure-time Tickets. Under Section 1837(j) of the Civil Code, the Buyer has no right to withdraw from the Purchase Agreement, even when purchased online.
The Organizer reserves the right to change the program, performers, date, or venue. Such changes do not entitle the Buyer to a refund.
If the Event is cancelled without replacement, the Buyer may request a refund under the specified conditions by emailing tickets@unitedislands.cz with a PDF copy of the Ticket.
Exceptions apply in cases of force majeure or if a substitute date is offered.
Lost or damaged Tickets are not replaced.
The Organizer is not responsible for non-delivery of Tickets due to issues on the Buyer’s side (e.g. full inbox, spam filters).
If the Ticket is not delivered within 1 hour after payment (or 5 days for bank transfer), the Buyer must contact info@goout.cz.
Tickets purchased outside the Online Shop cannot be claimed.
The Participant acquires no intellectual property rights to the Event name, symbols, logos, or other marks belonging to the Organizer.
The Organizer is not liable for stolen items unless stored in designated areas.
Each Participant is responsible for any damage they cause to third parties or the Organizer.
Participation is voluntary; each Participant bears responsibility for their actions.
The Organizer is not responsible for the health condition of Participants.
Use of drugs or prohibited substances is strictly forbidden. Open fires are prohibited except in designated areas.
The Organizer may expel a Participant who repeatedly violates rules without refund.
The Ticket allows entry to all artistic performances but does not include accommodation or catering.
Tickets are non-transferable and discounted pre-sale Tickets may not be resold.
Minors may attend only with an adult over 18, who is fully responsible for them.
Photography or recording is allowed only for authorized persons.
Participation implies consent to use of illustrative photographs unless the Participant objects at registration.
A consumer may submit a proposal for out-of-court dispute resolution to the Czech Trade Inspection Authority.
Consumers from other EU countries, Norway, or Iceland may use the European Consumer Centre.
Czech law applies. The UN Convention on Contracts for the International Sale of Goods is excluded.
Complaints may be submitted in writing or by email.
If any provision of these GTC becomes invalid, the remaining provisions remain effective.
These GTC are effective as of 4 December 2023.
